After over 80 sites were taken down in a crackdown by ICE (U.S. Department of Homeland Security) during an undercover 90 day investigation for allegedly copyright and trademark violations, it is now being stated site owners still have an opportunity to claim their domains.
The sites seized are stated to have ranged from counterfeit clothing, pirated software, music albums, videos, amongst other things, as reported on www.HipHopRx.com.
According to EW, Erik Barnett, assistant deputy director of U.S. Immigration and Customs Enforcement stated that the bloggers have the opportunity of filing court petitions to obtain their sites back, but none haven’t.
Many of the bloggers became enraged because they didn’t receive a notice. Barnett gave the reasoning as to being that they don’t notify criminals to end their criminal conduct and from the law’s end there’s criminal activity. Eric Barnett went on to state that there were complaints from rights holders that these sites were infringing on copyrights.
Suspects convicted could face anywhere from 5 and 10 years in prison.
Meanwhile, there are several groups joining together against the seizure of domains citing that the government is not abiding by the Digital Millennium Copyright Act (DMCA) where the infringing party must be notified to take the copyrighted materials.
