Charly Wingate, also known as rapper Max B, receives an appeal to try and overturn his September 2009 murder conviction.

A New Jersey judge has set a date for Max B to appeal his case in the hopes of overturning his conviction. His attorney, Joli O’Shay, has released a statement advising that Max B. will exhaust all available options to overturn the verdict.

Diplomat affiliate and ByrdGang member Max B, who served time in prison from 1997 to 2005 for robbery, overcame his incarceration to pursue music until 2009 when he was sentenced to 75 years for felony murder, kidnapping, conspiracy, aggravated manslaughter, and armed robbery for masterminding a 2006 heist in where one man lost his life. He was implicated in the crime because his ex-girlfriend, Gina Conway, testified that Max and his step brother, Kelvin Leerdam, in fact targeted two men at a Holiday Inn because they carried around loads of cash.

According to Max B’s close friend, French Montana, the rapper is in high spirits.

“He is hanging in there,” French Montana told AllHipHop.com. “..keep prayers up, that’s all you can do. They try to sabotage rappers. You know it is what it is man. Free Max B,” added Montana.
